Terms and Conditions for the LOST Application

1-Rights and Obligations:

This agreement sets forth all rights and obligations regarding LOSTKW, its users, affiliated App, and/or third-party users and/or those who interact with the services of LOSTKW without logging in and are registered. Please note that LOST reserves the right to change the terms of this agreement from time to time as LOST deems appropriate

2- Definitions

• "LOST" means the features and services provided through

(a) The LOSTKW app and any other Apps branded or co-branded by the Lost Company (including subdomains, international versions, widgets, and mobile versions);

(b) the LOSTKW player and viewer.

(c) the social components that enable users to interact with the posted material; and (c) other media, software (e.g., toolbars), tools, or networks now in existence or to be developed later.

• "Player and Viewer" means a set of APIs and services (e.g., content) that enable others, including app developers and website operators.

• "Information" means facts and other information about users, including actions taken by users and non-users who interact on the LOSTKW App and the App for this agreement.

• "Material" means all images (or information) of users posted on the LOST APP that are not included in the definition of information.

• "Data" or "User Data" means any data, including user content, material, or information, that users or third parties may retrieve from LOSTKW or provide to LOSTKW through the Operator and the Information Container.

This agreement is subject to the provisions of Regulation No. 26 of 2024 issued by the Communications and Information Technology Regulatory Authority (CITRA), which is the latest update to the data protection framework in Kuwait.

• "Posting" means uploading directly or through the LOST APP of material or otherwise making it available through the use of LOSTKW.

• "Use" means using, copying, performing, displaying in public, distributing, modifying, translating, and creating derivative works.

• “Users” means all logged-in users who have logged in as natural and/or legal individual users who are required to sign this Agreement, accepting the Terms of Use, and/or Team Contractors who have authorized their Teams and Materials to be published by authorizing such publication.

3-General Principles for Posting Material:

• Users will not post unauthorized commercial information messages (including spam) on the LOSTKW App.

• Users will not harvest User Content or Information or otherwise access the LOST APP using automated means (including harvesting bots, robots, spiders, or scrapers) without our prior permission. (All terms translated in this section refer to their common English names.)

• Users will not engage in illegal multi-level marketing, such as pyramid schemes or Ponzi schemes. They will only post photos or videos of the lost item for all site subscribers to see if the user has found it and to expand the search for lost items.

• Users will not upload viruses, malicious code, or other destructive software.

• Users will not attempt to obtain login information or access another person's account.

• Users will not harass, intimidate, or annoy any user.

• Users will not post content that is hate speech, threatening, obscene, incites violence, or contains nudity, graphic violence, or is gratuitous.

• Users will not develop or operate a third-party application containing alcohol-related, dating-related, or other adult content (including advertising) without appropriate age restrictions and approval from the site administration.

• Users must obtain contractual permission from LOSTKW and comply with applicable laws to post any posts, images, or videos outside of the scope of lost-person searches, including, but not limited to, advertising products or using specific software.

• Users will not use the website for any unlawful, misleading, malicious, or discriminatory conduct.

• Users will not do anything that disrupts, overburdens, or impairs the proper operation or appearance of LOSTKW, such as by attacking the site, denial of service, interfering with page or function submissions, or otherwise.

• Users will not facilitate or encourage any violations of these Terms.

• In order to help users maintain secure records on our App, we advise them to do the following:

• Do not provide any false personal information on LOSTKW and other related App/site operators, LOST Application (i.e., users who log in through Facebook or other social media platforms), or create an account for anyone other than yourself without permission.

• Do not create more than one personal account.

• If we suspend your account, users will not create another account without permission.

• Do not use your personal material for commercial purposes.

• Keep your contact information accurate and up to date.

• Do not share your password, allow anyone else to access your account, or do anything else that would compromise the security of your account.

• Do not transfer your account to anyone without first obtaining our written consent.

4- Protecting the rights of other people:

• We respect the rights of other people and expect users to do the same.

• Users will not post or take any action on LOSTKW that would infringe upon or violate another person's rights or otherwise be contrary to law.

• We may remove any content, material, or information posted by users if we believe it violates the laws and regulations of the publisher's country of origin or those of the publishing jurisdiction.

• If we remove your content due to infringement of someone else's copyright, and the user believes we removed it in error, we will provide the user with another opportunity to post if we do not receive any objection to the post from any other user.

• If users repeatedly infringe upon the intellectual property rights of others, we will disable the account as we deem appropriate.

• Users will not use the copyrights or trademarks of the site belonging to LOSTKW, its logos, or any similar marks in a confusing manner without prior written permission from us.

• Users will not post any person's identification documents or sensitive financial information on LOSTKW.

5- Termination:

• Subject to all the conditions mentioned in this agreement, if users or visitors violate the text of this agreement or the spirit of its terms or otherwise create a risk, challenge, potential legal claim or exposure to danger for us, we have the right to suspend the services provided in whole or in part without notice.

6- Judicial disputes and legal disputes:

• The user will resolve any claim, suit or other matter (claim/appeal) arising with LOSTKW on this matter exclusively or in connection with it in the courts of the State of Kuwait, and the Kuwaiti laws are the ones that apply to this agreement in addition to any claim that may arise between the user and LOSTKW.

• In the event that any claim is made against LOSTKW as a result of a user's conduct or material, content or information posted by the user on LOSTKW, the user will indemnify and hold LOSTKW harmless from and against all damages, losses and expenses of any kind (including legal fees and expenses) related to such claim. Although LOSTKW sets rules for user conduct, LOSTKW is not responsible for the content or information users post directly or indirectly on LOSTKW. We are not responsible for any offensive, indecent, obscene, illegal, or otherwise objectionable content or information that a user may encounter on LOSTKW. We are not responsible for the conduct of any user of the site, operator or viewer, whether online or offline.

• LOSTKW strives to maintain a virus-free and secure portal, and users must use it at their own risk. LOSTKW provides the Operator and Presenter Service as is without any express or implied warranties, including, but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement.

• LOSTKW does not guarantee that the Service will be timely, secure, error-free, or that it will always operate without interruptions, delays, or defects.

• LOSTKW is not responsible for the actions, content, information or data of third parties and users, including those who sign this agreement electronically, release us, our directors, shareholders, shareholders, employees, affiliates, partners, management staff and agents from any claims and/or damages and/or losses, whether known and/or unknown, arising from or in any way related to any claim made by the user against any aforementioned third parties.

• LOSTKW will not be liable to users for any lost profits or other consequential, special, indirect or incidental damages or losses arising out of or in connection with this agreement or the use of the LOSTKW site, even if LOSTKW has been advised of the possibility of such damages or losses.

• Our total liability arising from this agreement or through the use of the portal will not exceed the amount paid to us regarding the advertisement and for the period chosen for the continuation of the advertisement by the users.

• Applicable law may not allow the limitation or exclusion of liability or incidental or consequential damages. Accordingly, the above limitation or exclusion may not apply to certain users. In such cases, LOSTKW's liability will be limited to the minimum extent permitted by applicable law.

7- General provisions

  • This is an agreement between the user and LOSTKW and references to “we”, “us” and “our” mean either LOST, LOSTKW, LOST Portals or the owner of LOST as applicable.
  • This is the entire agreement between the two parties (the user and the Lostkw App), and it supersedes and replaces any previous agreements.
  • If any part of this Agreement is found to be unenforceable, the remaining part will remain in full force and effect.
  • If LOSTKW fails to enforce any provision of this Agreement or all of it, it will not be considered a waiver of the part that has not been enforced.
  • Any amendment to or waiver of this Agreement must be made by a written amendment signed by a representative of LOSTKW.
  • The user will not transfer any of his rights or obligations under this agreement to any other person without the approval of the LOSTKW administration.
  • All rights and obligations of LOSTKW under this Agreement are voluntarily assignable in any manner that LOST deems appropriate, whether in connection with a merger with another company, an acquisition of LOST by one company, a sale of LOST assets to another company, or by operation of law and/or otherwise.
  • This agreement binds both LOST and users to abide by all laws, regulations, and decrees in force in the State of Kuwait.
  • This Agreement does not grant any beneficial rights to a third party.
  • LOSTKW reserves all rights not expressly granted to the user(s).
  • The user(s) will abide by all applicable laws in force and in effect within the State of Kuwait and any laws that may be issued by the State of Kuwait when using or accessing LOSTKW.

الشروط والأحكام

  1. الحقوق والالتزامات

تُحدد هذه الاتفاقية كافة الحقوق والالتزامات المتعلقة باستخدام موقع LOSTKW، بما في ذلك مستخدمي الموقع، والمواقع التابعة له، ومستخدمي الأطراف الثالثة، سواء كانوا من المسجلين أو من المتفاعلين مع خدمات الموقع دون تسجيل. ويُرجى العلم بأن تطبيق LOST يحتفظ بالحق في تعديل شروط هذه الاتفاقية من وقت لآخر وفقًا لما تراه مناسبًا، دون الحاجة إلى إشعار مسبق.

  • تعريفات
  • " LOST "وتعني السمات والخدمات التي يتم توفيرها من خلال

(أ) ان تطبيق LOSTKW وأية مواقع إلكترونية أخرى تحمل الماركة the lost أو ماركة مشاركة لها (بما يشمل أسماء المجال الفرعية والنسخ الدولية والقطع ونسخ النقال؛

(ب) مشغل وعارضLOSTKW؛

(ج) المكونات الاجتماعية التي تساعد على تفاعل المستخدمين فيما يتعلق بالمادة المنشورة؛ و(الوسائط والبرامج الأخرى (مثل شريط الأدوات) أو الأدوات أو الشبكات القائمة حالياً أو التي يتم تقريرها لاحقاً.

  • "مشغل وعارض" وتعني مجموعة من (APIs) والخدمات (مثل المحتوى) والذي يؤدي إلى تمكين الآخرين بما يشمل مطوري التطبيق ومشغلي الموقع الإلكتروني.
  • "المعلومات" وتعني الحقائق والمعلومات الأخرى المتعلقة بالمستخدمين بما يشمل الإجراءات التي يتخذها المستخدمون وغير المستخدمين والذين يتفاعلون على المواقع الإلكترونية LOSTKW والموقع الخاص بهذه الإتفاقية.
  • "المادة" وتعني كافة الصور (أو المعلومات) والخاصة بالمستخدمين والمنشورة على تطبيق LOST APP والتي ليس من شأنها أن يتم شمولها في تعريف المعلومات.
  • "البيانات" أو "بيانات المستخدم" وتعني أية بيانات بما يشمل المحتوى الخاص بمستخدم أو المادة أو المعلومات والتي يمكن للمستخدمين أو الأطراف الثالثة استرجاعها من LOSTKW أو تزويدها إلى LOSTKW من خلال المشغل ووعاء المعلومات وتخضع لأحكام اللائحة رقم 26 لسنة 2024 التي صدرت عن الهيئة العامة للاتصالات وتقنية المعلومات (CITRA) والتي تُعد التحديث الأحدث لإطار حماية البيانات في الكويت..
  • "النشر" ويعني التحميل مباشرة أو عن طريق التطبيق LOST APP للمادة أو القيام خلاف ذلك بتوفيرها بواسطة استخدام LOSTKW
  • "الاستخدام" ويعني الاستخدام أو النسخ أو الأداء أو العرض بشكل عام أو التوزيع والتعديل والترجمة وإنشاء أعمال مشتقة.
  • "المستخدمون" ويعني كافة المستخدمين الذين سجلوا دخولهم والذين قاموا بتسجيل دخولهم في كمستخدمين فرديين طبيعيين و/أو إعتباريين والذين يتعين عليهم توقيع هذه الاتفاقية بقبول شروط الاستخدام و/أو متعهدي الفريق الذين سمحوا لفرقائهم ولموادهم بأن يتم نشرها بتفويض ذلك النشر.
  1. المبادئ العامة لنشر المادة:
  • لن يقوم المستخدمون بوضع رسائل معلومات تجارية غير مصرح بها (ومنها الرسائل غير المرغوب بها) على الموقع الإكتروني (LOSTKW).
  • لن يقوم المستخدمون بجمع محتوى أو معلومات مستخدمين أو الدخول خلافاً لذلك إلى LOST APP باستخدام وسيلة آلية تلقائية العمل (ومنها Harvesting bots حصاد (بوتس) أو Robots الانسان الآلي أو Spiders العناكب أو Scrapers الكاشطات) بدون اذن مسبق منا. (جميع المصطلحات المترجمة في هذا البند متعلقة بأسماءها المتعارف عليها باللغة الإنجليزية).
  • لن يقوم المستخدمون بالاشتراك في التسويق المتعدد المستويات غير القانوني مثل البرنامج الهرمي أو نظام البونزي وانما فقط نشر صور او مقاطع فيديوا لما هو مفقود لعرضة على كافة المشتركين في الموقع لمعرفة ما اذا كان احمد المستخدمين قد وجده ولتوسيع عمليه البحث عن الأشياء المفقودة.
  • لن يقوم المستخدمون بتحميل فيروسات او رمز خبيث وآخر مُخرب.
  • لن يقوم المستخدمون بالسعي للحصول على معلومات الدخول أو الوصول إلى حساب عائد إلى شخص آخر.
  • لن يقوم المستخدمون بمضايقة أي مستخدم أو تخويفه أو ازعاجه.
  • لن يقوم المستخدمون بنشر محتوى من شأنه أن يكون: خطاباً يبعث على الكراهية أو تهديداً أو فيه كلاماً فاحشاً أو محرضاً على العنف أو يحتوي على عري أو عنف تصويري أو لا مبرر له.
  • لن يقوم المستخدمون بتطوير أو تشغيل تطبيق طرف ثالث يحتوي على اشياء ذات علاقة بالكحول أو المواعدة أو المحتوى الآخر الخاص بالبالغين (بما يشمل الإعلانات) بدون فرض قيود ملائمة على العمر بموافقة إدارة الموقع.
  • يتعين على المستخدمين الحصول على اذن عقدي من إدارة LOSTKW والتقيد بالقوانين السارية لنشر أي منشورات او صور او فيديوهات خارج نطاق البحث عن المفقود على سبيل المثال لا الحصر الدعاية عن منتجات او استخدام برامج معينه الخ
  • إن المستخدمين لن يقوموا باستخدام الموقع الإلكتروني لأي تصرف غير شرعي أو مضلل أو ماكر أو ينطوي على تمييز العنصري.
  • لن يقوم المستخدمون بفعل أي شيء من شأنه أن يعطل العمل أو المظهر الملائمين لـ LOSTKWأو يحمله فوق طاقته أو يعيقه وذلك مثل الهجوم التخريبي على الموقع أو الحرمان من الخدمة أو التشويش بتقديم صفحة أو تقديم لوظيفة أو أي طريقة أخرى.
  • لن يقوم المستخدمون بتسهيل أو تشجيع أية مخالفات لهذه الشروط.
  • لغايات التمكن من مساعدة المستخدمين على المحافظة على السجلات بطريقة امنه على موقعنا، فإننا ننصحهم بما يلي:
  • عدم تزويد أية معلومات شخصية زائفة على LOSTKWوعلى مشغلات المواقع / الموقع الأخرى ذات الصلة تطبيق LOST (أي المستخدمين الذين يسجلون الدخول من خلال الفيسبوك أو منصات الوسائط الاجتماعية الاخرى) أو إنشاء حساب لصالح أي شخص سواك بدون اذن.
  • عدم إنشاء أكثر من حساب شخصي واحد.
  • في حال قمنا بايقاف حسابك، فإن المستخدمين لن يقوموا بإنشاء حساب آخر بدون اذن.
  • عدم استخدام مادتك الشخصية لأغراض تجارية .
  • حافظ على دقة معلومات الاتصال الخاصة بك وقم بتحديثها.
  • لا تتشارك في كلمة السر الخاصة بك أو تسمح لأي شخص آخر بالدخول إلى حسابك أو تقوم بأي شيء آخر من شأنه الإضرار بأمن حسابك بتعريضه للخطر.
  • عدم تحويل الحساب الخاص بك إلى اي شخص دون الحصول أولاً على موافقتنا الخطية.
  1. حماية حقوق الأشخاص الاخرين:
  • إننا نحترم حقوق الأشخاص الآخرين ونتوقع من المستخدمين القيام بذلك.
  • لن يقوم المستخدمون بالنشر أو اتخاذ أي إجراء على LOSTKWمن شأنه أن يتعدى على حقوق شخص آخر أو ينتهكها أو أن يكون مخالفاً للقانون خلافاً لذلك.
  • يمكننا إزالة أي محتوى أو مادة أو معلومات يقوم المستخدمون بنشرها في حال كنا نعتقد بأنها مخالفة لقوانين وأنظمة بلد منشأ الناشر أو تلك الخاصة بولاية النشر القضائية.
  • في حال قمنا بإزالة المحتوى الخاص بك نتيجة التعدي على حق التأليف الخاص بشخص آخر وكان المستخدم يعتقد بأننا قمنا بإزالته بالخطأ، فإننا سنوفر للمستخدم فرصة أخرى للنشر في حال لم يردنا اية بلاغ اعتراض على المنشور من قبل أي من المستخدمين الاخرين.
  • في حال كان المستخدمون يتعدون بشكل متكرر على حقوق الملكية الفكرية الخاصة باشخاص آخرين، فإننا سنعطل الحساب حسب ما نراه ملائماً.
  • إن المستخدمين لن يقوموا باستخدام حقوق التأليف أو العلامات التجارية الخاصة بالموقع والعائدة إلى LOSTKWأو شعاراته أو أية علامات مشابه بشكل يبعث على التشويش بدون إذن خطي مسبق منا.
  • لن يقوم المستخدمون بنشر وثائق التعريف الخاصة باي شخص أو معلومات مالية حساسة على LOSTKW
  1. الإنهاء:
  • مع مراعاة كافة الشروط المذكورة في هذه الاتفاقية، وفي حال كان المستخدمون أو الزوار يخالفون نص هذه الاتفاقية أو روح شروطها أو يقومون خلافاً لذلك بايجاد خطر أو طعن أو ادعاء قانوني محتمل أو تعرض لخطر بالنسبة لنا، فإننا نتمتع بالحق للقيام بدون إشعار بتعليق الخدمات التي يتم تزويدها كلياً أو جزئيا.
  1. النزاع القضائي والخلافات القانونية
  • سيقوم المستخدم بحل أي ادعاء أو دعوى أو خلافه (ادعاء/طعن) ينشأ مع LOSTKW عن هذا الشأن حصرياً أو فيما يتعلق به لدى محاكم دولة الكويت ، وإن القوانين الكويتية هي التي تطبق على هذه الاتفاقية إضافة إلى أي ادعاء قد ينشأ فيما بين المستخدم و LOSTKW.
  • في حال تم تقديم أي ادعاء ضد LOSTKWنتيجة لتصرف من طرف المستخدم او المادة أو المحتوى أو المعلومات الموضوعة من قبله على LOSTKW، فإنه سيعوض LOSTKWويجنبها الضرر الناشيء عن كل عطل وضرر وعن الخسائر والمصاريف مهما كان نوعها (بما يشمل الرسوم القانونية والمصاريف) المتعلقة بذلك الادعاء. وبالرغم من أن LOSTKW يرسي قواعد لسلوك المستخدم، فإن LOSTKW ليس مسؤولاً عن المحتوى أو المعلومات التي يقوم المستخدمون بنشرها مباشرة أو بشكل غير مباشر علىLOSTKW وإننا لسنا مسؤولين عن أي محتوى أو معلومات مهينة أو غير لائقة أو فاحشة أو غير شرعية أو عرضة للاعتراض خلافاً لذلك بما قد يواجهه المستخدم على LOSTKW وإننا لا نتحمل المسؤولية عن سلوك أي مستخدم لمشغل وعارض الموقع سواءً على الشبكة أو خارجها.
  • إن LOSTKWيسعى للاحتفاظ ببوابة تخلو من الفيروسات وتكون آمنة وعلى المستخدمين أن يستخدمونها على عاتقهم الخاص. وإن LOSTKW يقوم بتزويد خدمة المشغل والعارض كما هي بدون أية ضمانات صريحة أو ضمنية بما يشمل على سبيل المثال لا الحصر ضمانات القابلية للتجارة أو الملائمة لغرض معين وإمكانية التعدي .
  • إن LOSTKW لا يضمن السلامة كل الوقت أو الأمان او الخلو من الخطأ أو أنه سيكون عاملاً دوماً بدون انقطاعات أو تأخيرات أو عيوب.
  • إن LOSTKW لا يتحمل المسؤولية عن التصرفات أو المحتوى أو المعلومات أو البيانات الخاصة بإطراف ثالثة وإن المستخدمين بما فيهم المُوقع على هذه الإتفاقية إلكترونياً يبرؤننا ومدرائنا والمساهمين فينا والمساهمين لدينا وموظفينا والتابعين لنا وشركائنا وطاقم إدارتنا ووكلائنا من أية ادعاءات و / او عطل و/ او ضرركان ذلك معلوماً و/أو غير معلوم بما ينشأ عن أي إدعاء يتوفر للمستخدم بمواجهة أية أطراف ثالثة مذكورة أو يتعلق به بأي شكل.
  • إن LOSTKW لن تكون مسؤولة تجاه المستخدمين عن أية أرباح فائتة أو عطل اوضرر آخر لاحق أو خاص أو غير مباشر أو طارئ ينشأ عن هذه الاتفاقية أو من خلال استخدام الموقع LOSTKWأو فيما يتعلق بذلك حتى وإن كان LOSTKWقد تم إشعاره باحتمالية وقوع ذلك العطل والضرر.
  • إن مسؤوليتنا الاجمالية الناشئة عن هذا الاتفاقية أو من خلال استخدام البوابة لن تتجاوز المبلغ المدفوع إلينا بشأن الإعلان وعن الفترة التي يتم اختيارها لاستمرار الاعلان من طرف المستخدمين.
  • إن القانون المطبق قد لا يسمح بتحديد أو استثناء المسؤولية أو العطل اوالضرر الطارئ أو اللاحق، وعليه، فإن التحديد أو الاستثناء أعلاه قد لا ينطبق على مستخدمين معينين. وفي تلك الحالات، فإن مسؤوليةLOSTKW ستكون محدودة بأقل درجة يسمح بها القانون المطبق.
  1. احكام عامة
  • إن هذه اتفاقية مبرمة فيما بين المستخدم وLOSTKW وإن الإشارات إلى "نحن" و"لنا" و"إيانا" تعني إما LOST أو LOSTKW أو بوابات LOST أو مالك LOST حسب مقتضى الحال.
  • إن هذا هو مجمل الاتفاق الجاري فيما بين الطرفين (المستخدم و lost ) وهو يسود على أية اتفاقيات سابقة وينسخها.
  • في حال تبين بأن أي جزء من هذه الاتفاقية لا يمكن تنفيذه، فإن الجزء المتبقي سيبقى نافذا وسارياً بشكل تام.
  • في حال أخفق LOSTKWفي تفعيل أي شرط وارد في هذه الاتفاقية أو ككل، فإنه لن يعتبر تنازلاًمنه عن الجزء الذي لم يتم تفعليه.
  • إن أي تعديل يجري على هذه الاتفاقية أو تنازل عنها يتعين ان يتم بموجب تعديل خطي موقع من قبل ممثل LOSTKW
  • إن المستخدم لن يقوم بنقل أي من حقوقه أو التزاماته بموجب هذه الاتفاقية إلى أي شخص آخر بدون موافقة إدارة LOSTKW
  • إن كافة حقوق والتزامات LOSTKWبموجب هذه الاتفاقية هي قابلة للإحالة بطواعية بأي شكل يراه LOST ملائماً سواءً فيما يتعلق باندماج مع شركة أخرى أو استحواذ شركة على LOST أو بيع موجودات LOST لشركة أخرى أو بمقتضى القانون و/أو خلافه.
  • إن هذه الاتفاقية تقيد كلا من LOST والمستخدمين بالالتزام بكافة القوانين والنظم والمراسيم السارية في دولة الكويت كافة .
  • إن هذه الاتفاقية لا تخول أية حقوق نفعية لطرف ثالث.
  • إن LOSTKWيحتفظ بكافة الحقوق التي لم يتم منحها إلى المستخدم/المستخدمين بشكل صريح.
  • إن المستخدم/المستخدمين سيتقيد/سيتقيدون بكافة القوانين المرعية والمعمول بها داخل دولة الكويت والسارية واية قوانين قد تصدر عن دولة الكويت عند استخدام LOSTKWأو الدخول إليه.
